Herb Estreicher and David Fischer Quoted in Chemical Watch Article on Debate Surrounding TSCA Process for Rejected PFASs

Keller and Heckman Partner Herb Estreicher and Counsel David Fischer were quoted in the Chemical Watch article “TSCA approach for addressing abandoned PFASs may invite criticism.” The article discusses the controversy regarding the U.S. Environmental Protection Agency’s (EPA) strategy to use their new authority under significant new use rules (SNURs) as part of the Toxic Substances Control Act (TSCA) to handle abandoned per- and polyfluoroalkyl substances (PFASs). The rule could impact more than 40,000 inactive PFASs listed in the TSCA inventory. When discussing substances in commerce Herb said, “If something is no longer in commerce, you don’t gain a lot by banning it, except you ensure it’s no longer introduced.” According to David, the Agency could also use SNURs for active chemicals to expand the scope of an assessment.
