Peter Craddock Quoted in Lexology PRO Article on Challenging EDPB Decisions

Keller and Heckman Partner Peter Craddock was quoted in the Lexology PRO article, “EDPB decisions can be challenged, ECJ rules.” The article reveals that WhatsApp’s challenge to the European Data Protection Board’s (EDPB) 2021 decision against it was recently ruled admissible by the European Court of Justice (ECJ), meaning WhatsApp can now challenge the €225 million fine in the General Court.

The decision may open the door for more companies to challenge EDPB decisions, which are binding on all supervisory authorities. “I think it will shape the space of data protection litigation for years to come,” noted Peter.

“This is a true confirmation they [EDPB] are not above the rules and cannot decide what they want without any consequences,” he added.
