Peter Craddock Quoted in Global Data Review Article on TikTok EDPB Challenge

Keller and Heckman Partner Peter Craddock was quoted in the Global Data Review article, “TikTok: EDPB binding decision process breaches EU law.” The article discusses TikTok’s challenge against the European Data Protection Board (EDPB), arguing that the EDPB’s dispute resolution process is incompatible with EU fundamental rights.

Peter noted that TikTok has resorted to a reference to fundamental rights because the EDPB – in issuing a binding decision – takes a position on certain aspects that “does not leave room for manoeuvre for the local authority.”

“It’s very important that TikTok makes these arguments because the EDPB so far has been taking these decisions with relative impunity – there is basically no way of holding them to account,” said Peter.
