Peter Craddock Quoted in Global Data Review Article on IAB Adtech Appeal

Keller and Heckman Partner Peter Craddock was quoted in the Global Data Review article, “ECJ to hear key questions in IAB adtech appeal.” The article discusses how a Belgian court has asked the European Court of Justice (ECJ) to rule on two main questions regarding the nature of personal data and controllership in the most recent turn in the dispute over IAB’s advertising technology. Peter weighed in on the questions, saying that he expects the ECJ will follow its own example in the Breyer case regarding the question of whether the TC String comprises personal data. “There are lots of other kinds of information that are being considered as personal data by authorities where we might actually need to question that,” Peter argued. “This preliminary reference could be very important from a much broader perspective. Just think about things like cookie identifiers – that could also be a relevant question. If I just have a general cookie identifier, is that personal data if I don’t have any means of associating it with a person? It could have a very far-reaching impact.”
