Keller and Heckman Partner Lawrence Halprin was quoted in the Inside OSHA article, “In Early Test Of Vaccine Mandates, Judges Back Broad State-Level Rule.” The article discusses the U.S. Court of Appeals for the 1st Circuit’s decision to uphold Maine’s COVID-19 vaccine mandate for healthcare workers against claims of exemptions based on religious freedom. According to Lawrence, the court’s ruling follows past legal precedent on the question of if health and safety rule exceptions place “undue hardship on employers.” This precedent may also help defend against impending challenges to the Occupational Safety and Health Administration’s (OSHA) emergency temporary standard (ETS).
