Keller and Heckman Partner Herb Estreicher was quoted in the Chemical Watch article, “TSCA Implementation May Be ‘Significantly Different’ Under Biden.” The article discusses how the Biden administration’s directive to scrutinize the procedures underlying TSCA risk evaluations could have big implications for the future of substance assessment at the US Environmental Protection Agency. How those changes might play out remains an open question. Despite the Biden administration’s call to reexamine the 2017 final risk evaluation rule, those codified procedures can’t be undone overnight.

"Once a rule has been finalized, a new administration would be required to undergo the rulemaking process to change or repeal all or part of the rule," Mr. Estreicher said.
