David Fischer quoted in InsideEPA article on EPA’s D4 Evaluation under TSCA

Keller and Heckman Counsel David Fischer was quoted in the InsideEPA article “ACC Warns EPA Against ‘Binary’ D4 Evaluation Under Current TSCA Rules.” The article discusses the American Chemistry Council’s (ACC) notice to the U.S. Environmental Protection Agency (EPA) to clarify whether the Agency plans on using its systemic review process established under the Trump Administration, or if as indicated by EPA’s chemical chief, Michal Freedhoff, EPA plans to issue single, binary risk determinations for chemicals such as D4 being reviewed. According to David, EPA “can’t just say they’ve had a change of heart” regarding the framework. Instead, he notes that the EPA will need go through the lengthy process “to reissue that rule … to reflect the change in interpretation.”
