David Fischer Quoted in Inside TSCA Article on TSCA Improvement Coalition Seeking Broader Reforms

Keller and Heckman Partner David Fischer was quoted in the Inside TSCA article, “Former Trump Chemicals Deputy’s Coalition Seeks Broader TSCA Reforms.” The article covers the efforts of the industry-led TSCA Improvement Coalition, managed by former EPA official David Fischer, to press lawmakers for a broad set of reforms to the Toxic Substances Control Act (TSCA). 

David said it was “good to see” some of the coalition’s proposals included in House Republicans’ draft bill, but noted he “was hoping it would include more items that…would be bipartisan,” prompting the coalition to submit additional recommendations. These proposals include expanding advisory committee roles, defining key regulatory terms, revising new chemical review procedures, and directing EPA to finally issue rules on substantial risk reporting (changes David said “read as pretty reasonable”). 

The coalition hopes these updates, along with an extension of EPA’s user fee authority, can be included in upcoming legislation, while David acknowledges that “if we can’t get anywhere on the statutory side, we can still get somewhere on the regulatory or policy side,” should Congress fail to act.
