David Fischer Quoted in Inside TSCA Article on Government Shutdown Impact on TSCA
Keller and Heckman Counsel David Fischer was quoted in the Inside TSCA article, “EPA Poised To Shut Down TSCA Program Despite Funding From User Fees.” The article indicates that despite the user fees EPA collects for mandated activities under Toxic Substances Control Act (TSCA) sections 4, 5, and 6, the TSCA program will not operate during the government shutdown. The U.S. Environmental Protection Agency (EPA) did not provide an explanation as to why the TSCA program is unable to operate on industry fees, but multiple sources noted that the fees would be insufficient to keep even limited operations going.
“I question how feasible it is to run OPPT on user fees alone,” commented David.
