David Fischer Quoted in Inside TSCA Article on Addressing Existing Chemicals in TSCA Reform

Keller and Heckman Counsel David Fischer was quoted in the Inside TSCA article, “Industry Worries TSCA Reform Push May Not Address Existing Chemicals.” The article notes industry concern that revising TSCA’s approach to pre-market reviews of new chemicals may not leave enough time to focus on reform for existing chemicals. David noted he is aware of the worry that lawmakers may not get to section 6, but he is optimistic and working with the coalition to advocate for more changes beyond just the new chemicals language in section 5.

“I think folks are open to the idea that if a provision is not working the way we’d expected, let’s fix it,” he said. David added that he hopes the strategy is to begin discussions “with section 5 and a collaborative spirit and if we are successful there, expand to other provisions. I think that’s the calculus.”

At a minimum, David hopes “if we can’t get all the change we want, at least [the statute will be] clear what Congress is asking EPA to do … because we’re clearly not all on the same page.”
