David Fischer Quoted in Inside PFAS Policy Article on Advocacy for PFAS Reporting Waivers

Keller and Heckman Counsel David Fischer was quoted in the Inside PFAS Policy article, “Optimistic Industry Groups Ramp Up Advocacy For PFAS Reporting Waivers.” The article notes that many industry groups are ramping up their advocacy in hopes that the Trump EPA will include several exemptions requested by industry in the agency’s revised PFAS reporting rule under the Toxic Substances Control Act (TSCA).

“My sense is that EPA wants to make this a workable rule and is therefore open to all the requests we [had] in our petition,” said David. The petition, authored earlier this year on behalf of chemical companies, urged EPA to exempt several per- and polyfluoroalkyl substances (PFAS) uses from upcoming reporting obligations in the TSCA rule.

Fischer said that while he remains “optimistic that the rule will be fairly comprehensive” in the scope of its exemptions, he is still working to create another coalition, like the one behind the petition, to comment on the rule and meet with OMB to advocate for exemptions.

“And I’ve got to believe that a lot of [the trade groups] are doing that too,” he said.
