As nanotechnology gains a foothold in the marketplace European and U.S. regulators are struggling to develop an appropriate regulatory regime to address these new and promising technologies.  In the U.S., the Environmental Protection Agency (EPA) has promulgated a new data collection rule under Section 8(a) of the Toxic Substances Control Act (TSCA) specific for nanomaterials.  In the European Union, the European Commission and the European Chemical Agency (ECHA) are struggling to respond to recent ECHA Board of Appeal decisions that roll back the regulators efforts to subject nanomaterials to registration under REACH.
