Keller and Heckman Partner David Fischer will present at the myLawCLE Program, “After East Fork: How the Methylene Chloride Vacatur Could Reshape TSCA Risk Evaluations and Risk Management Rules," to be held virtually on November 9, 2026.

The Fifth Circuit’s East Fork decision vacating EPA’s methylene chloride rule raises broader questions about how EPA conducts TSCA risk evaluations and develops risk management rules. The ruling may affect challenges to other TSCA rules, including those for TCE, PCE, and carbon tetrachloride, by scrutinizing key EPA judgments underlying "unreasonable risk" determinations. This session provides a framework for identifying the risk evaluation decisions supporting TSCA rules and assessing how vulnerable existing regulations may be to similar legal challenges.
