Herb Estreicher offered an industry perspective in the InsideEPA.com article "NRDC Suit Faces Hurdles but May Dissuade EPA Use of New Chemicals Plan." The National Resources Defense Council (NRDC) has filed suit challenging EPA's draft framework, which sought to speed the review and approval process for new chemicals under TSCA.  Herb reiterated the long-standing industry assertion that the suit will fail on procedural grounds, as "You can't file a lawsuit, at least not successful ones, against draft documents, proposed rules, discussion documents, anything of that nature."
