Keller and Heckman LLP and Cardno ChemRisk present a webinar series on the changes to the Toxic Substances Control Act (TSCA) resulting from the June 22, 2016 passage of the Frank R. Lautenberg Chemical Safety for the 21st Century Act (Lautenberg Act).

February 8, 2017 Topic: The Chemical Prioritization Rule and Its Implications

This month's discussion surrounded the Chemical Prioritization Rule proposed on January 17, 2017 by the U.S. Environmental Protection Agency (EPA). Section 6(b)(1)(A) of TSCA now requires EPA to promulgate procedures for prioritizing chemicals for risk evaluations, which must include the criteria for high-priority and low-priority chemical designations. The proposal indicates that EPA is setting a low bar for high-priority designations and that EPA anticipates designating a large number of chemical substances as high-priority. This webinar discussed:

  • EPA’s use of evaluation criteria from the Work Plan Chemicals Program;
  • A Work Plan Chemical case study;
  • The prioritization process and timeline;
  • Uses subject to review;
  • Preemption implications;
  • Predicting future chemicals for prioritization; and
  • What manufacturers should do.
