Sheila Millar Quoted in Law.com Article on Oregon’s Packaging EPR Law
Keller and Heckman Partner Sheila Millar was quoted in the Law.com article, “Oregon Ruling Gives a Boost to State Recycling Laws.” The article discusses a federal court ruling upholding Oregon’s extended producer responsibility (EPR) law, which requires companies to help fund the recycling of packaging and paper products.
Sheila noted that, in the near term, “there will be a scramble to pay the fees and avoid fines,” and that the ruling demonstrates the legal headwinds facing challenges to EPR laws. She also warned that if Oregon’s law and similar state EPR programs are upheld, they could impose a “crushing financial burden” on some companies, make it harder to use protective packaging, and ultimately increase costs for consumers.
Considering these practical concerns, she said, some companies might want to advocate for changing the laws through legislation.
