Eve Pelonis Quoted in Inside Health Policy Article on FDA Leadership and Food Policy

Keller and Heckman Partner Eve Pelonis was quoted in the Inside Health Policy article, “Diamantas’ FDA Tenure Could Stretch As Food, Supplement Decisions Loom.” The article discusses uncertainty around FDA leadership as Acting Commissioner Kyle Diamantas may remain in his role longer than anticipated, and what that could mean for the agency’s ongoing food policy priorities.

“I think that that emphasis will continue, because it resonates well with the public, and it's something that they want to focus on in light of the midterms approaching,” Pelonis said, noting that food policy will remain a priority even amid leadership uncertainty at the FDA. However, she does not expect Acting Commissioner Kyle Diamantas’ elevation to accelerate regulatory action, adding, “I don't anticipate that happening. Anything in the regulatory realm takes time, and I think they, frankly, have been going as fast as they can go.” 

Pelonis emphasized that GRAS reform remains a key uncertainty for FDA, as a proposed rule requiring mandatory notices and limiting self-affirmed determinations is still under review. “The GRAS proposed rule, I think, is kind of a question mark,” she said, adding that “there is that uncertainty…creating some anxiety,” making it difficult for companies to plan ahead.
