Eric Gotting Quoted in Nicotine Insider Article on Youth-Use Evidence

Keller and Heckman Partner Eric Gotting was quoted in the Nicotine Insider article, “Drip More: FDA Ignored Youth-Use Evidence.” The article reports that Drip More LLC argued before the Ninth Circuit that the U.S. Food and Drug Administration (FDA) wrongly denied its premarket tobacco product applications (PMTA) by ignoring evidence showing youth were not using its products.

Eric emphasized that National Youth Tobacco Survey data from 2019 to 2021 showed no youth respondents reported using Drip More products. “Not a single minor in 2019, 2020, 2021 identified this product,” he told the court.
