Azim Chowdhury Quoted in 2Firsts Article on U.S. Tobacco Advertising Warnings

Keller and Heckman Partner Azim Chowdhury was recently quoted in a 2Firsts article, “Special Report | Altria's NACS Booth Raises Questions Over U.S. Tobacco Advertising Warnings.” The article examines questions raised about whether advertising displayed at Altria’s booth at the 2026 NACS Show complied with federal tobacco warning requirements.

To assess the issue, 2Firsts consulted Azim, who explained that federal warning regulations for e-cigarettes and nicotine pouches generally apply regardless of whether advertising is directed at consumers or retailers. He stated, “I am not aware of any exemption in the regulation, or in FDA guidance, simply because the advertisement appears at a B2B or adult-only trade show.”

Azim also explained that warning labels on product packaging do not automatically satisfy separate advertising-warning requirements. Even if a package warning is visible in an enlarged product image, or a warning appears elsewhere in a booth, each individual advertisement must include its own warning that meets the required placement and format standards.
