Time is running out for manufacturers/users of certain substances listed on the European positive lists (EUPL) for materials intended to come in contact with drinking water. The EUPL will apply from 31 December 2026 and many of the listings for these substances, especially those used in organic and cementitious materials, are set to expire on 31 December 2028.
To keep your materials on the market beyond that date, companies should be prepared to generate the necessary data and submit their petitions to ECHA to avoid disruptions or market bans.
Importantly also, companies that need to petition substances not already included in the EUPL will typically not be able use those substances until they are included in the EUPL (unless an exemption applies), so a careful and timely assessment of the available options for individual substances is critical to ensure a successful marketing plan.
