Keller and Heckman Partner Azim Chowdhury will present at the 8th Annual Next Generation Nicotine Delivery USA, to be held in Miami, Florida on June 3-4, 2026.
His presentation, “Updates on the FDA Guidance on Enforcement Priorities for Unauthorized ENDS and Nicotine Pouch Products,” will offer an overview of the FDA’s new enforcement priorities framework, including what has changed—and what has not—for unauthorized products. It will cover key eligibility criteria for lower enforcement priority, such as accepted and filed PMTAs under the post November 2021 framework and qualifying sPMTAs, and explain why timely submission under earlier deadlines is no longer sufficient. The session will also address special considerations for flavored ENDS, including FDA’s added data requirements and how these relate to broader evidentiary standards. Finally, it will highlight practical impacts on the market, including the FDA’s upcoming public list, increased import and illicit product enforcement, retailer and distributor responsibilities, and potential conflicts with state PMTA directory laws.
