Thomas Berger Authors Specialty Chemicals Magazine Article on TSCA Enforcement

Keller and Heckman Partner Thomas Berger authored the Specialty Chemicals Magazine article, “TSCA: A trap for the unwary,” which provides an overview of some key pitfalls of enforcement of the Toxic Substances Control Act (TSCA). 

Thomas begins the article by urging organizations to learn how their business can successfully navigate TSCA’s regulatory and penalty schemes. “Companies that conduct business in the US,” he writes, “including some that may not traditionally regard themselves as ‘chemical’ companies, would be well advised to be mindful of the requirements of and the penalties for non-compliance with the general chemical regulatory law in the US.”

The article goes into depth on inspection and liability, civil and criminal penalties, and TSCA’s enforcement process, ending with another warning for companies to “be wary indeed.”
