Allison (Alli) Payne advises Keller and Heckman clients on regulatory and compliance matters under state and federal environmental, chemical, and occupational safety and health laws.
Specifically, clients seek Alli’s guidance on issues arising under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the Emergency Planning and Community Right-to-Know Act (EPCRA), the Toxic Substances Control Act (TSCA), the Clean Air Act (CAA), the Federal Trade Commission (FTC) Act, and other federal and state regulatory programs, as well as international pesticide and chemical regulations.
Prior to joining Keller and Heckman, Alli served as an attorney-advisor within the Pesticides and Toxic Substances Law Office for the U.S. Environmental Protection Agency’s (EPA) Office of General Counsel, where she advised EPA program offices on a wide variety of matters under chemical and pesticide laws.
Alli’s extensive background, which combines environmental science and the law, serves her well in helping clients maintain safe and healthy workplaces by ensuring compliance with all relevant regulations and guidelines.
Representative Matters
- Reached favorable settlement of several enforcement cases brought by EPA and state agencies for alleged violations of FIFRA, TSCA, and state pesticide laws, including a settlement with CA DPR resulting in a $400,000 civil penalty reduction
- Obtained several civil penalty mitigations for potential TSCA and FIFRA violations under EPA’s “Audit Policy” and similar state agency policies
- Drafted comments on behalf of industry in response to several EPA TSCA section 6 actions
- Reviewed numerous proposed advertisements and advertising campaigns and counseled on compliance with EPA’s FIFRA regulations and treated article exemption guidance
- Advised on import and/or registration of antimicrobial pesticides and chemicals under several international regulatory schemes
