Kristine Modica advises clients on litigation matters in multiple areas, including toxic torts, pharmaceuticals, products liability, and environmental actions.  She represents clients, including emerging start-ups to Fortune 500 companies, before state and federal courts (including hundreds of cases in federal multidistrict litigation).

Kristine is adept at identifying pathways to resolve client disputes before the need for litigation; however, if litigation is unavoidable, her extensive experience from law clerk to attorney proves invaluable to clients. She handles all aspects of litigation, including research, fact and expert discovery, and motions practice, including drafting discovery requests and responses, motions in limine, dispositive motions, Daubert briefs, as well as other briefs and pleadings. 

Her unique background in pharmaceutical litigation, which required analyzing scientific literature and medical records, offers a deeper understanding of the complexity surrounding litigation for clients of the Firm involved in the scientific industry.

Representative Matters

  • Represented multinational agricultural chemicals company in product liability, pesticide drift congenital disability, and environmental actions before state and federal courts throughout the United States, including mass tort and multi-district litigation
  • Conducted extensive internal investigation regarding PFAS groundwater contamination and hazardous waste disposal on behalf of a manufacturer in indemnification action
  • Represented insurer in bad faith and extra-contractual liability cases in defense of asbestos and catastrophic personal injury actions
  • Drafted memoranda in civil lawsuits related to constitutional rights violations
