Arturo Reyes

Arturo Reyes advises domestic and foreign clients on compliance with California’s Proposition 65, as well as food and food-contact material requirements, in a host of jurisdictions. He counsels clients on U.S. Food and Drug Administration (FDA) and U.S. Department of Agriculture (USDA) regulations relating to food, alcoholic and non-alcoholic beverages, cosmetics, and food contact materials.  

Arturo helps prepare Food Contact Notifications by working with in-house chemists and toxicologists and routinely advises clients on regulations that govern food contact materials in the United States, the EU, Latin America, Asia, Africa, and the Middle East.  He also prepares FDA No Objection Letter requests (NOLs) for recycling processes and counsels clients on Proposition 65 warning requirements.  

Arturo further assists clients by reviewing food labeling and promotional materials, including suitable common or usual names, ingredient declarations, nutrition labeling, health claims, nutrient content claims, and allergen labeling. He prepares labeling information for food products marketed in Australia, Canada, Mexico, Hong Kong, Taiwan, and the Philippines.  

While in law school, Arturo served as the Executive Acquisitions Editor of the Hastings Environmental Law Journal and participated in a corporate law clinic, where he advised clients on a variety of corporate governance, compliance, transactional, and operational matters. He also served as a law clerk, where he contributed to litigation by drafting pleadings on multiple legal issues. 

Prior to attending law school, Arturo worked as a litigation paralegal and, before that, as a fellow at the New York City Mayor’s Office, where he worked with numerous city officials, including the Food Policy Coordinator for the City of New York. This experience has enabled him to assist Keller and Heckman Partners with food policy issues and requirements brought to us by our clients. 

Representative Matters

  • Prepared opinion letters regarding the status of novel food ingredients and food-contact materials in the United States and other international jurisdictions 
  • Counseled critical infrastructure food companies on federal, state, and local requirements involving COVID-19 workplace safety protocols
  • Advised food delivery companies and retail food establishments on compliance with federal, state, county, and local food safety regulations
  • Assisted in the preparation of self-determined Generally Recognized as Safe (GRAS) positions for food ingredients
  • Provided advice on compliance with labeling requirements and requirements applicable to health and nutrient content claims, and other claims, including “all natural,” “healthy,” “grass-fed,” and “Keto” 
  • Advised restaurant chains on federal menu labeling regulations
  • Helped beverage companies ensure compliance with FDA and Alcohol and Tobacco Tax and Trade Bureau (TTB) regulations for a wide variety of alcohol beverage products, including wines, hard seltzers, ciders, and beers
