Taylor Johnson Quoted in SHRM Article on OSHA’s ‘Severe Violator’ List

Keller and Heckman Associate Taylor Johnson was quoted in the SHRM article, “OSHA Expands Who May Wind Up on Its ‘Severe Violator’ List.” The article discusses the Occupational Safety and Health Administration’s (OSHA) announcement to expand the criteria for placement in its Severe Violator Enforcement Program (SVEP) list. As of September 15, 2022, more employers may find themselves on this list, due to a number of reasons. Taylor specifically noted, “Employers that commit two or more willful or repeated violations or receive two or more failure-to-abate violations are now pulled into the program regardless of the OSHA standard at issue.” In addition to an expansion of criteria for placement on the SVEP list, employers can expect greater enforcement follow-up activity and more significant penalties.
