Keller and Heckman Partner Sheila Millar was quoted in the Law.com article, “JBS Settlement With AG Over Climate Pledge Offers Lessons for Companies and Regulators.” The article explores JBS’s recent settlement with New York’s attorney general about the company’s sustainability commitments.
“What you see in final settlement with the parties is an acknowledgment that the judge who heard this matter was very skeptical of the complaint,” noted Sheila. “The AG is being pretty aggressive on claims, probably pushing the envelope of what might be misleading.”
Sheila pointed out that JBS had actually spent money on reducing emissions, a significant factor. A company that simply claimed it was planning to reach net zero but took no actions would likely be more vulnerable, she said.
“My shorthand way of talking to clients is, don’t make stuff up,” said Sheila. “You have to substantiate your claims, whatever those claims may be.”
