John Gustafson counsels Keller and Heckman clients on regulatory compliance and litigates related matters under state and federal environmental, advertising, occupational safety and health, and labor laws.

Specifically, clients seek John’s counsel on issues arising under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the Federal Trade Commission Act (FTC Act), the Occupational Health and Safety (OSH) Act, the Toxic Substances Control Act (TSCA), California's Proposition 65, and various state and federal labor and employment laws.

John has represented clients in litigation at trial and appellate levels in federal and state courts, participated in U.S. Environmental Protection Agency (EPA) and California Department of Pesticide Regulation (CDPR) enforcement negotiations, and appealed standards developed by private standards-development organizations. He assists clients with business-to-business contracting conflicts, advertising disputes, and labor and employment issues.

John regularly provides pro bono services, working with groups such as the DC Bar’s Landlord Tenant Resource Center (LTRC), the Legal Counsel for the Elderly, and as associate counsel in a 42 U.S.C. § 1983 prisoner case.

Prior to joining Keller and Heckman, John clerked for The Honorable Judge Douglas R.M. Nazarian on the Maryland Court of Special Appeals.

  • Negotiated cost-effective settlements with EPA and state environmental agencies in pesticide product advertising dispute
  • Obtained EPA and state letters of exemption from state and federal pesticide law regulation 
  • Counseled novel pesticide product innovator through FIFRA Section 3 registration process
  • Coordinated defense of consumer antimicrobial-treated article company in National Advertising Division (NAD) business-to-business dispute
  • Briefed food recall indemnity suit in United States Court of Appeals for the Ninth Circuit against foreign supplier of adulterated produce
  • Appealed American National Standards Institute (ANSI) standard revisions on Constitutional due process grounds
