Reconsideration/Effective Date of FCC Pole Attachment Order June 8
The Federal Register today published the Commission's April 7 Pole Attachment Order [click here for a copy], making June 8, 2011 the effective date for the new regulations, with the exception of those pertaining to make-ready deadlines, hiring of contractors and ILEC complaints, to become effective following OMB review. The filing date for Petitions for Reconsideration of all aspects of the Order is June 8, 2011. Keller and Heckman LLP is assembling a Coalition of investor-owned utilities to fight this Order by filing a Petition for Reconsideration. Commission Seeks Comment on PTC Spectrum Needs
A Public Notice released by the FCC on Friday seeks comment on spectrum needs for positive train control ("PTC") projects. The Rail Safety Improvement Act mandates PTC on most major track lines by the end of 2015, and the Commissions wants feedback from stakeholders regarding the amount and type of frequency needed to properly implement PTC, as well as suggestions for facilitating the acquisition of said spectrum.
