DOE General Counsel: Any Vacated Federal Spectrum Will Likely Not Be Made Available to Utilities

At an Federal Communications Bar Association meeting last week, Department of Energy General Counsel Scott Harris summarily dismissed the possibility that utilities might secure a dedicated spectrum allocation derived from spectrum that may potentially be vacated by the federal government. Harris emphasized the similarities between utilities and public safety entities, urging utilities to focus instead on sharing arrangements with public safety entities.

CII Entities Urge Commission to Act on Stalled AMTS Applications

In a letter filed with the FCC last week on behalf of Critical Infrastructure Industry firms and other clients, Keller and Heckman llp urged the Commission to grant assignment applications for AMTS (217/219 MHz) band licenses that are being held in abeyance pending the Commission's resolution of a dispute involving Maritime Communications/Land Mobile, LLC. The applications, some of which have been delayed over 18 months, have been stalled by Petitions to Deny filed by other AMTS licensees controlled by Warren Havens, and other issues regarding MCLM. The letter did not take a position on the merits of the underlying proceedings, but requested that the Commission find a solution under which the pending assignment applications may be granted in a timely manner.

Verizon Appeals FCC's Net Neutrality Order

On January 20, 2011, Verizon Communications appealed the FCC's recently adopted Net Neutrality Order to the U.S. Court of Appeals for the D.C. Circuit. Given the significant impact of the regulations on broadband Internet service providers, it is not surprising that Verizon is seeking judicial review.
