FCC to Consider Pole Attachment Order and Rulemaking at Open Meeting

The tentative agenda for the FCC's next Open Meeting, scheduled for May 20, 2010, includes a pole attachment Order and Further Notice of Proposed Rulemaking (FNPRM) implementing the FCC's National Broadband Plan (NBP). Keller and Heckman previously sent letters to the FCC Chairman and Commissioners on behalf of the "Coalition of Concerned Utilities" (Allegheny Power, Baltimore Gas & Electric, Dayton Power & Light, FirstEnergy, Kansas City Power & Light, National Grid, NSTAR and PPL Electric Utilities) highlighting concerns with proposals made in the NBP proceeding and criticizing the pole attachment section of the NBP for ignoring electric utility concerns while citing liberally from nearly 20 different communications attachers (See Vol. VII, Issue 8, Issue 9, and Issue 12).

FCC Seeks Comment on Motorola Request Regarding Low Power 450-470 MHz Frequencies

As previously reported (See Vol. VII, Issue 12), the FCC is seeking Comment on a Request by Motorola for a Declaratory Ruling that low power systems authorized pursuant to Section 90.267 of the Commission's rules are not required to adhere to five megahertz separations between paired 450-470 MHz band base and mobile frequencies. In the event that five megahertz separation is required for low power frequencies, Motorola requests a blanket waiver. Comments were due by April 19, but the deadline for filing Reply Comments has been extended from May 4 to May 14.

FCC Launches Spectrum Task Force

Last week, the FCC announced the launch of a Spectrum Task Force to implement recommendations in the NBP, promote spectrum efficiency, and ensure sufficient spectrum for broadband. The Task Force will be led by the FCC's Office of Engineering Technology and Wireless Telecommunications Bureau Chiefs, and will include Chiefs of the Enforcement, International, Media, and Public Safety and Homeland Security Bureaus, as well as the Chief of the Office of Strategic Planning and Policy Analysis.

Next FCC Open Meeting Scheduled for May 20, 2010

The FCC is scheduled to hold its next Open Meeting on May 20, 2010. Tentative agenda items include: (1) a pole attachment Order and FNPRM; (2) the 14th Mobile Wireless Competition Report; (3) a Report and Order regarding mobile broadband use of 25 MHz of spectrum in the 2.3 GHz Wireless Communications Service band; and (4) a Report and Order on local number portability.
