For those of you wondering how much a cost-based rate would enable utilities to charge for attachments to transmission towers, a recent decision of the California Public Utilities Commission ("CPUC") may be instructive.
In Daniels Cablevision, Inc. v. San Diego Gas & Electric Co. (CPUC Decision 03-05-055, May 22, 2003), the CPUC calculated a cost-based rate for attachments by a cable company to both wooden and steel poles located within SDG&E's transmission rights-of-way. The CPUC allowed SDG&E to recover $22.12 for attachments to wooden poles and $278.97 for attachments to steel poles. An allowance was made to recover a portion of the transmission right-of-way fees paid by SDG&E to private landowners.
