Mary E. Pivec is a member of the Keller and Heckman Employment Practice Group. She has more than 25 years' experience advising employers in a broad range of workplace and labor relations issues. Prior to her legal practice, Ms. Pivec worked as a union business agent negotiating collective bargaining agreements and representing employees in grievance and arbitration proceedings. Since becoming a lawyer, she has represented management interests exclusively in collective bargaining, unfair labor practice proceedings and grievance arbitration cases.
In addition to representing employers in discrimination, wrongful discharge, wage and hour, non-compete and contract litigation in federal and state courts and administrative agencies, Ms. Pivec also has a substantial whistleblower claim defense practice, handling investigations, hearings and appeals of claims brought under the Sarbanes Oxley Act, the Surface Transportation Assistance Act, the Occupational Safety and Health Act, and the environmental whistleblower statutes.
Since 1987, Ms. Pivec also has represented employers in civil and criminal worksite enforcement cases, I-9 audits, and immigration-related discrimination claims litigation. In 1990, her labor/immigration defense practice expanded to include H-1B/LCA investigations and enforcement proceedings brought by the U.S. Department of Labor Wage and Hour Division.
Ms. Pivec enjoys an AV© Peer Review Rating, was named among the Washington, D.C. "Super Lawyers" in the Labor and Employment field for 2007, 2008 and 2009 and has been featured in Best Lawyers in America since 1990 in the area of Immigration law. She was elected to the Board of Governor of the American Immigration Lawyers Association, where she served nine years, and is a regular speaker in AILA and State Bar sponsored events throughout the United States on the subject of immigration worksite enforcement.
